1. Nature of Service
Vahos is a technology platform that connects users (Senders) with independent third-party travelers (Carriers) for the transportation of parcels via public transport networks (Train, Metro, Bus). Vahos does not own vehicles, nor is it a common carrier.
2. Package Restrictions (Strict Compliance)
To ensure the safety of Carriers and compliance with Railway Acts, all parcels must adhere to the following:
- Weight Limit: Maximum 5 kg per parcel.
- Size Limit: Must fit within a standard backpack or small handheld bag (Max dimensions: 45cm x 35cm x 20cm).
- Prohibited Items: No flammable liquids, explosives, weapons, illegal drugs, currency, jewelry, or perishable items. Vahos reserves the right to inspect packages.
3. Limited Liability (Lost or Damaged Goods)
Vahos operates on a "Said to Contain" basis. Since we do not verify the internal contents of every sealed package, our liability is capped.
Maximum Payout: In the event of proven loss or damage caused by the Carrier's negligence, Vahos's liability is limited to the lower of:
- The actual declared value of the item.
- Ten times (10x) the delivery fee paid for that specific trip.
Fragile Items: Any item made of glass, ceramics, or sensitive electronics is transported at the Sender's sole risk. Vahos is not liable for internal damage to electronics if the external packaging remains intact.
4. Reporting Window
- 24-Hour Rule: Any claim for loss or damage must be reported in writing (via app or email) within 24 hours of the scheduled delivery time.
- Evidence: The claimant must provide clear photos of the packaging and damage, along with a valid invoice/bill for the item.
5. Indemnity & User Responsibility
- Legal Compliance: The Sender represents that the parcel does not violate any local laws or Mumbai Railway/Metro regulations.
- Sender Indemnity: The Sender agrees to indemnify Vahos against any legal action, fines, or penalties imposed by authorities (Railway Police, BMC, etc.) resulting from the contents of the package.
- Carrier Conduct: Vahos is not liable for delays caused by train cancellations, mega-blocks, or force majeure events (e.g., monsoon flooding).
6. Scope of Service & Platform Role
Vahos (the "Company") provides a technology platform that connects Senders ("Users") with independent third-party travelers ("Carriers") who facilitate the movement of parcels via public transit.
- Non-Carrier Status: Vahos is a facilitator only. We do not own the transit vehicles (Trains/Buses/Metros) nor are we a common carrier.
- Traveler Autonomy: Carriers are independent individuals using public transport for their own travel; they are not employees of Vahos.
7. Package Restrictions (Strict)
To ensure compliance with the Indian Railways Act and Metro Railway Rules, the following restrictions apply:
- Weight Limit: Maximum 5.0 kg per booking.
- Dimensions: Must fit within a standard backpack (45cm x 35cm x 20cm).
- Prohibited Items: Users shall not send flammable, explosive, or hazardous materials.
- Illegal substances, contraband, or counterfeit goods.
- Currency, bullion, or high-value jewelry/precious metals.
- Fragile items (Glass, Ceramics, Perishables) - Sent at User's own risk.
- Right to Inspect: Vahos and its Carriers reserve the right to inspect any package to ensure it does not contain prohibited items.
8. Limited Liability (Loss & Damage)
Vahos operates on a "Said to Contain" basis.
Liability Cap: Our total liability for any loss, theft, or physical damage to a parcel is limited to the lower of:
- The actual cost/value of the item (supported by an original invoice).
- Ten times (10x) the freight/delivery fee paid for that specific trip.
- Exclusions: Vahos is NOT liable for indirect, incidental, or consequential losses (e.g., loss of profit or business).
- Damage to fragile items or electronic failure without external packaging damage.
- Items seized by authorities (RPF, Police, Metro Security) due to the nature of the content.
9. Claims and Reporting Window
- 24-Hour Rule: Any claim for damage or loss must be filed in writing (email or app) within 24 hours of the delivery timestamp.
- Documentation: Claims must include clear photos of the package (before and after), the invoice, and proof of booking. Failure to report within 24 hours results in a waiver of the right to claim.
10. User Warranties & Indemnity
- Compliance: The User warrants that the parcel does not violate any local laws or the terms of the transit provider (WR, CR, or Mumbai Metro).
- Indemnity: The User agrees to indemnify and hold Vahos harmless from any fines, legal fees, or damages resulting from the User's breach of these terms or the carriage of prohibited items.
11. Force Majeure
Vahos is not liable for delays or non-delivery caused by events beyond its control, including but not limited to:
- Train/Metro cancellations or "Mega Blocks."
- Monsoon-related floods or strikes (Bandhs).
- Technical outages on Render.com or third-party payment gateways.
12. Privacy & Data (DPDP Act 2023 Compliance)
- Vahos collects personal data (Names, Numbers, GPS) solely for fulfilling the delivery.
- Purpose Limitation: Data is only used for the specific delivery transaction.
- Data Deletion: User and Carrier data is deleted or anonymized once the purpose (delivery + 24hr claim window) is fulfilled, unless required for legal records.
